Any use of the Site by Client after the 30-day period shall be deemed to constitute your acceptance of such changes, modifications or additions.

3. ELECTRONIC COMMUNICATIONS. When you visit the Site, or have exchanges with the Company through the Site, that communication is communication with the Company electronically. You consent to receive communications from the Company electronically. The Company will communicate with you by e-mail to the most recent e-mail address provided to the Company by you or by posting notices on this Site. It is your responsibility to provide an e-mail address at which you will receive e-mail communications and to update your e-mail address as necessary to maintain your e-mail account. You agree that all agreements, notices, disclosures and other communications that the Company provides to you electronically, either by posting on this Site or to the e-mail address provided by you will satisfy any legal requirement that such communications be in writing.


This Terms of Use Agreement (“Agreement”) is a legal contract between you and CLAUDIANA BEAUTANICA™ that governs the terms under which you will be permitted to access the CLAUDIANA BEAUTANICA™ website (the “Site”) and/or use of the services provided on the Site. CONSENT TO USE OF DATA; PRIVACY. At CLAUDIANA BEAUTANICA™ we understand your concerns about your private information. For that reason, we have created the ClAUDIANA BEAUTANICA™ Privacy Policy, (“Privacy Policy”) which is wholly incorporated into this Agreement. You can read the full terms of the Privacy Policy, as may be amended from time to time, by clicking here. You agree that CLAUDIANA BEAUTANICA™ (or its agents) may collect and use the technical and personal data that it gathers solely to improve its products and your experience with the Site, its services and products. USER ACCOUNT. When visiting the Site, you will have the option to create a CLAUDIANA BEAUTANICA™ User Account. The purpose of the CLAUDIANA BEAUTANICA™ User Account is to streamline your experience with us. It is designed to help us serve you by saving information about you, your product preferences and purchase history. You will have the option of storing credit card or other information in your CLAUDIANA BEAUTANICA™ User Account, so that you can avoid resending the information each time an order is placed. A CLAUDIANA BEAUTANICA™ User Account will also allow you to see the status of your pending orders, view your saved shopping baskets and purchase history. CLAUDIANA BEAUTANICA™ DOES NOT MAKE ANY WARRANTY THAT ACCESS TO THE SITE OR THE SERVICES LICENSED HEREIN WILL MEET YOUR REQUIREMENTS OR THAT ACCESS OR SERVICES WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. CLAUDIANA BEAUTANICA™ MAKES NO WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USING THE WEBSITE, SERVICES OR THE PRODUCTS SOLD THEREON. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CLAUDIANA BEAUTANICA™ SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. TO THE EXTENT THAT CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY. IT IS AGREED THAT THE EXCLUSIONS SHALL APPLY TO FULLEST EXTENT PERMITTED BY LAW.

EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT (OTHER THAN INJURY TO THE PERSON IN THE CASE OF CONSUMER GOODS) SHALL CLAUDIANA BEAUTANICA™ BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PROSPECTIVE BUSINESS ADVANTAGE, , FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF, MISUSE OF OR INABILITY TO USE THE SITE, SERVICES OR PRODUCTS PROVIDED IN CONNECTION WITH THE SITE, OR OTHERWISE ARISING OUT OF THE USE, MISUSE OR UNAVAILABILITY OF THE SITE OR SERVICES OR PRODUCTS PROVIDED IN CONNECTION WITH THE SITE OR IN CONNECTION WITH ANY PROVISION OF THIS AGREEMENT, EVEN IN THE EVENT OF THE FAULT, TORT, INCLUDING NEGLIGENCE, MISREPRESENTATION, STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF CLAUDIANA BEAUTANICA™, BUT EXCLUDING GROSSLY NEGLIGENT, RECKLESS AND INTENTIONAL ACTS OF CLAUDIANA BEAUTANICA™, AND EVEN IF CLAUDIANA BEAUTANICA™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES (OTHER THAN INJURY TO THE PERSON IN THE CASE OF CONSUMER GOODS) SHALL CLAUDIANA BEAUTANICA™ BE LIABLE FOR YOUR USE OR MISUSE OF THE SITE, SERVICES OR CONTENT PROVIDED IN CONNECTION HEREWITH. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY AND PUNITIVE DAMAGES, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE, BUT EXCLUDING GROSSLY NEGLIGENT, RECKLESS AND INTENTIONAL ACTS OF CLAUDIANA BEAUTANICA™ ) OR OTHERWISE (EVEN IF CLAUDIANA BEAUTANICA™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE SITE OR ANY SERVICES OR PRODUCTS PROVIDED IN CONNECTION THEREWITH, INCLUDING DAMAGES THAT MIGHT BE INCURRED BY THIRD PARTIES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING A FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND THE FULLEST EXTENT PERMITTED BY LAW.

EXCLUSIVE REMEDY. You agree that CLAUDIANA BEAUTANICA™ ’s sole liability and your exclusive remedy, in law, in equity or otherwise, with respect to the Products, Services or for any breach of this Agreement or the incorporated Privacy Policy is solely limited to the return of the amount paid by you to CLAUDIANA BEAUTANICA™ or $100, whichever is greater.

APPLICABLE LAW. This Agreement will be governed by and construed in accordance with the laws of the State of New York, excluding its conflict of laws rules. You and CLAUDIANA BEAUTANICA™ hereby agree to submit to the sole and exclusive subject matter jurisdiction, personal jurisdiction and venue of the Supreme Court State of New York, County of New York, or the United States District Court, Southern District of New York.

YOUR CONDUCT. From time to time, there may be opportunities for you to communicate with others through the Site, including chat rooms, postings, emails, etc. You agree that you shall use the Site for lawful purposes only. You shall not post or transmit through the Site any material that violates or infringes in any way upon the rights of others. You also agree that you will not use lewd language, threaten physical or personal harm or otherwise engage in objectionable conduct while communicating with others through the Site, including CLAUDIANA BEAUTANICA™ product representatives. CLAUDIANA BEAUTANICA™ reserves the right to remove any material posted by you to the Site that CLAUDIANA BEAUTANICA™ in its sole discretion, believes is lewd, threatening, inappropriate, objectionable, unlawful, in violation of the rights of others or otherwise in breach of this Agreement. You shall indemnify CLAUDIANA BEAUTANICA™ and its affiliates (including, but not limited to, its owners, employees, officers and agents) for all third-party claims, including reasonable attorney’s fees, resulting from your use of the Site.

MISCELLANEOUS PROVISIONS.

(a) If for any reason a court of competent jurisdiction finds any provision or portion thereof to be unenforceable, the remainder of the terms of the Agreement shall continue in full force and effect.

(b) This Agreement, the Privacy Policy and any expressly incorporated document represents the entire Agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or Agreements, written or oral.

(c) Any waiver of any provision of this Agreement will be effective only if in writing and signed by CLAUDIANA BEAUTANICA™. The failure by CLAUDIANA BEAUTANICA™ to enforce any provision of this Agreement or portion thereof does not act as a waiver or estop CLAUDIANA BEAUTANICA™ from enforcement of the remaining terms.

(d) The section headings appearing in this Agreement are inserted for convenience only and in no way define, limit, construe or describe the scope or extent of any section or, in any way, affect such section.

Shipping Policy
All orders are processed within 3 to 5 business days. After receiving your order confirmation email, you will receive another notification when your order has shipped.

Domestic Shipping Rates
For calculated shipping rates: Shipping charges for your order will be calculated and displayed at checkout.

We currently ship within the United States of America only.

Returns & Exchanges
PRODUCT RETURNS. CLAUDIANA BEAUTANICA™ is unable to offer returns or exchanges at this point due to general dissatisfaction. At this time, we are not in a position to offer a money back guarantee or exchange unless the product is faulty or damaged. We want you to be delighted with your purchase, but there may be occasions when you feel it necessary to return a product due to it being faulty or damaged. If this happens, let us know by emailing info@claudianabeautanica.com within 48hrs of receiving the item, stating your order number. You have the right to then return the faulty or damaged items within ten working days of delivery, for our assessment. If the faulty or damaged item is successfully returned and received within the ten working days, and the fault or damage assessed and an exchange granted, we will give you a free exchange. You must use a paid for tracking service to return faulty or damaged items. Shipping costs will be reimbursed once received. Losses through the carrier service are dealt with on a case by case basis. Place item(s) in it its original packaging. Please ensure that it is packed well so as to reach us in the received state.
Enclose a copy of the receipt/packing slip.

We recommend that you track your return package, to ensure receipt, using the United States Postal Service UPS, or Federal Express.
The cost of return shipping is your responsibility.

In these Terms of Trade, "Claudiana Beautanica" means Claudiana Beautanica USA Inc. trading as Claudiana Beautanica, 'you' means the organisation or individual who is ordering product on the website, and the "Products" means the Claudiana Beautanica products which may be ordered on the website.

These Terms of Trade apply to any purchase of any Products by you from this website which are delivered in the United States.

Digital Gift Card
A Claudiana Beautanica Digital Gift Card entitles the owner to purchase products up to the nominated value from Claudiana Beautanica's online store within the country and currency in which the card was purchased. The value on the card can be used for purchases in whole or in part, and on multiple occasions at said Claudiana Beautanica online store. It cannot be reloaded, exchanged or redeemed for cash, or transferred to another digital gift card or owner. Claudiana Beautanica Digital Gift Cards are valid for 12 months from the date of purchase and currently applicable in the United States of America. After the expiry date, the card will have a nil balance. To verify available funds at any time, please visit Claudiana Beautanica online at Check gift card balance. Each Claudiana Beautanica Digital Gift Card is linked to a unique Gift Card Number and Pin to ensure its security and integrity, and allow for multiple transactions online.
